Welcome to the JMOdp platform, owned and operated by JMOdp Corp. ("JMOdp," "we," or "us"). These Terms of Service (including our Code of Conduct and Privacy Policy) (the "Terms of Service") constitute a contract between you and JMOdp. By using JMOdp.com (the "Website"), creating a JMOdp account, and using the Website or our mobile applications to contribute content to the JMOdp community (including stories, comments, and messages you create), or accessing and viewing JMOdp Content or other User Content (collectively, the Website, the "Service"), you agree to these Terms of Service. If you disagree with any of these Terms, you may not use the JMOdp Service.
JMOdp has established a policy regarding copyright infringement on the Service in accordance with the United States Digital Millennium Copyright Act ("DMCA"). While our policy is based on United States law, it applies globally in all jurisdictions where we offer our Service. If you would like to submit a claim of copyright infringement, please visit our "Report Copyright Infringement" page. JMOdp reserves the right, in its sole discretion, to remove allegedly infringing content without prior notice and without liability to you or anyone else. In appropriate circumstances, we will also terminate the accounts of users identified as repeat infringers.
We occasionally encounter websites that illegally scrape content from JMOdp. Once we discover these websites, we make every effort to shut them down. To act on behalf of users, we need your legal permission, which we request here when you register. You authorize us to act as your agent to issue takedown notices under the Digital Millennium Copyright Act (DMCA) and/or any other similar law or regulation permitting requests to internet service providers and any other person engaging in the unlawful distribution of content, requesting the removal of infringing or allegedly infringing copyrighted material contained or displayed on such service providers' platforms and/or services.
The following subsections apply only to the fullest extent permitted by applicable law. Some jurisdictions do not allow the disclaimer of implied warranties or limitation of liability in contracts, so the contents of this section may not apply to you. Nothing in this section is intended to limit any rights you may have that are not legally limited.
No Warranties. Your use of our Services and any Content is entirely at your own risk and discretion. We provide them to you on an "as is" and "as available" basis. This means we provide no warranties, either express or implied. JMOdp specifically disclaims any implied warranties of merchantability, merchantable quality, fitness for a particular purpose, availability, security, title, or non-infringement, as well as any warranties implied from course of dealing or course of performance.
Liability for Content. All Content, whether publicly posted or privately transmitted, is the sole responsibility of the content creator. We do not monitor or control the Content posted through the Services and assume no responsibility for such Content. We do not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted through the Services, nor do we endorse any opinions expressed through the Services. You understand that by using the Services, you may be exposed to content that is offensive, harmful, inaccurate, or otherwise inappropriate, or, in some cases, posts that are mislabeled or otherwise deceptive.
Disclaimer of Liability. By using the Services, you release JMOdp from any claims, damages, and demands of any kind, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way connected with (a) any disputes between users or between users and any third party arising out of or related to the use of the Services; and (b) the Services.
Changes. Our Terms of Service may change from time to time. If we do, we will notify you of any material changes by posting a notice on the website or sending you an email. Please note that your continued use of the Services after any changes constitutes your agreement to be bound by the new Terms of Service. If you disagree with any changes to the Terms of Service and do not wish to be bound by the revised terms, you will need to close your account and/or stop using the Services.
Entire Agreement. These Terms of Service (including any documents incorporated by reference) constitute the entire agreement between JMOdp and you regarding the Services, and these Terms of Service supersede and replace any prior agreements between JMOdp and you regarding the Services.
Non-waivable and inseverable. If JMOdp does not exercise or enforce a particular right or provision under these Terms of Service, it does not constitute a waiver of such right or provision. If any provision of these Terms of Service is held invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms of Service will remain in full force and effect.
Choice of Law and Jurisdiction. JMOdp recommends that you contact us with any questions rather than resort to legal action. In the event of legal action, these Terms of Service will be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable in Ontario, without regard to conflict of law principles. You agree that any dispute or claim arising out of or relating to these Terms of Service will be heard exclusively in the courts of Ontario.
Assignment. These Terms of Service are for your personal use only. You may not assign, transfer, or sublicense these Terms of Service without JMOdp's prior written consent. JMOdp reserves the right to assign, transfer, or delegate any of its rights and obligations under these Terms of Service without notice and your consent.
